Terms Of Services

1. Domain Name Registration

  1. We cannot guarantee that the domain name you want can be registered or will be registered in your name. You should wait for confirmation that your domain has been registered before taking any further steps. Anything you do before getting this confirmation is at your own risk.
  2. Domain registration and use are subject to the rules of the official domain authority. You are responsible for knowing and following those rules. If your domain name request is denied, you cannot hold us responsible. Also, any fees you pay to us are non-refundable, even if the domain name is not approved.
  3. We are not responsible for how you use your domain name. If someone else has a dispute with you over the domain, it's up to both parties to settle it. In such cases, we may choose to suspend, cancel, or hold the domain without explanation. We might inform the domain authority, but we are not required to get involved.
  4. We won't transfer your domain to another provider unless we've received full payment for it.

2. Web Site Hosting And Email

  1. We don't guarantee the accuracy or quality of information received through our servers and aren't responsible for any loss or damage to your data.
  2. You should have your own backup or insurance for any data stored on our servers.
  3. You represent, undertake and warrant to us that you will use the Web Site allocated to you only for lawful purposes. In particular, you represent, warrant and undertake to us that:
  4. You won't use our servers in ways that break the law or violate others' rights.
  5. You won't post or link to:
    • -Anything illegal, abusive, offensive, or inappropriate (as judged by us).
    • -Viruses or harmful software.
    • -Anything that supports criminal activity or violates intellectual property rights.
  6. No sending of bulk or spam emails from our servers or promoting your site through spam.
  7. Don't run programs that overuse system resources. We don't allow IRC or other resource-heavy software.
  8. If you exceed your plan's limits (disk/bandwidth), you must pay for the extra usage immediately and without dispute.
  9. We may remove content we find inappropriate from your website without warning. We don't allow warez, underage adult content, pornography, or copyrighted MP3s.
  10. Keep your login details secure and let us know right away if your account is compromised.
  11. Follow our guidelines and don't harm the experience of other users.
  12. Free hosting users don't qualify for promotions offered to paid users.
  13. Free hosting users must display a cloudbillsystems banner on their site.
  14. All emails sent must follow the law and be done securely.
  15. Unsolicited emails (spam) are not allowed. You also can't use someone else's server to send emails through us without permission.
  16. You must not:
    • -Post off-topic messages in forums, groups, or mailing lists.
    • -Send mass emails, even if they're opt-in.
    • -Use our servers to assist in or support these activities.
    • -Give false information to us or others when using our services.
  17. If you break these rules:
    • - We may investigate and restrict your access.
    • - We may suspend or cancel your account or take legal action.
    • - If it's a crime, we'll report it to the authorities.
    • - You must cover any costs we face because of your violation (including legal fees).
    • - Postmaster handling: $100/hour (minimum 1 hour)
    • - $1 per spam email or complaint
    • - Server maintenance: $85/hour
  18. No service credits will be given for downtime caused by policy violations.
  19. If you access other networks through us, follow their rules too.
  20. We work hard to keep the server secure, but we can't guarantee protection from hackers or email issues.
  21. You can cancel services anytime through our support system after verification.
  22. No refunds if you've used the service or received freebies like domain migration, custom setup, or scripts.
  23. Fair Support Use: If you submit too many support tickets (especially for VPS installs/rebuilds), you may be charged extra admin fees

Service Availability

  1. We aim to keep the server and services available at all times, but we are not responsible for any interruptions or downtime.
  2. We may suspend services at any time for any reason, usually without notice. If the suspension lasts or is expected to last more than 7 days, we'll let you know why.
    • * If you are a reseller or have sub-clients, you are responsible for backing up your own sites and your clients' sites.
    • * We also have the right to refuse service to any client at our discretion and take no responsibility for doing so.
    • * Please note, we do not offer compensation for any network downtime.
  3. Your account and services are for your use only and cannot be shared or transferred to others.
    • * You can only have one active login session per account at a time.
    • * If you have more than one account, each system account can only have one session active at a time.
    • * If we find that your account has been shared or used improperly, we may cancel your account and stop services immediately.

Payment

  1. All service fees must be paid in advance and follow the prices listed on our website. We may change prices at any time, but if you've prepaid, your price is locked in for that period.
  2. Payments are due every month, quarter, or year, depending on your plan, starting from the day your service began. If you pay by credit or debit card, you allow cloudbillsystems to charge your card for renewals automatically.
  3. All payments must be made in U.S. Dollars.
  4. If your check bounces, you'll be charged a $45 fee.
  5. If you miss a payment, we may suspend your services right away, without affecting our right to take other actions.

Termination

  1. If you don't pay on time, we can suspend your services or cancel your account immediately without notice.
  2. If you break any of our terms, we can also suspend or cancel your services right away without notice.
  3. We have the right to suspend or cancel your services at any time without notice.
  4. No refunds will be given if your services are suspended or canceled for the above reasons.
  5. If we cancel your services for reasons not related to a violation, you may receive a partial refund for the unused time.
  6. You can cancel your services anytime by logging into the support system and requesting cancellation.
  7. If you cancel within the first 30 days, you may get a refund excluding domain registration, dedicated servers, data transfer fees, and excessive support use.
    • - We decide whether your reason qualifies for a refund and will subtract the excluded fees.
  8. If you cancel within the first 14 days, you're eligible for a full refund (except for the items excluded above).
    • - After 14 days, refunds are partial and decided by us.
  9. Reseller accounts may get a refund (minus usage fees) but don't qualify for our standard 30-day money-back guarantee due to higher resource use.
  10. If you had a previous account with us, you can't get a refund under this policy.
  11. Refunds can take up to 30 days to process. If you don't receive it by then, please contact us
  12. If you paid by credit or debit card, the refund will go back to that same card.
  13. If your account is suspended or canceled, we will block your website and delete your data immediately.

Indemnity

  1. You agree to protect us from any loss or damage that happens because you broke these terms or misused our services.
  2. If someone else makes a claim against us because of your actions, you will be responsible for all costs, including legal fees, losses, or damages we may face as a result.

Limitation Of Liability

  1. We do not offer any warranties about the services, except what is specifically stated in these terms. This includes excluding implied warranties like satisfactory quality and fitness for a specific purpose.
  2. We are still responsible for any death or injury caused by our negligence, no matter what.
  3. Our total liability to you for any claims (whether in contract, tort, or otherwise) is limited to the amount you paid for the specific services related to that claim.
  4. You must notify us within one year if you have a claim. If you don't, we cannot accept the claim.
  5. We are not responsible for any loss of business, profits, or savings, or any other indirect or economic loss.
  6. You are responsible for keeping track of your bandwidth and disk space usage, which you can do through your Control Panel. If you exceed the limits in your plan, you'll be charged extra according to our pricing.

Notices

  1. Any notice between both parties can be sent by email, fax, or recorded delivery to the address listed in this Agreement or any other address provided in writing.
    • - Email: Considered received on the day it's sent unless proven otherwise.
    • - Fax: Considered received when you get an error-free transmission report.
    • - Recorded Delivery: Considered received two days after it's posted.

Support

  1. You'll find everything you need to get your website running on our site. Your account details should have been included in the Welcome Letter you received when we set up your account. If you didn't get the email, please contact our Support Team. Sometimes the email doesn't reach you, especially if it was sent to the same domain you're using for your services.
  2. Our support currently focuses only on server-related issues.
  3. For scripting support, we have online tutorials available. You can also hire our technicians for $80 per hour (with a half-hour minimum). We may waive this fee at our discretion.
  4. Support is only available in English through our Support System.
  5. All support requests must go through our Support System. Requests made elsewhere (unless noted in Section 9.5) are considered a violation of our Terms of Service.
  6. If there's a server issue or emergency, you can contact us by any method.

Law

This Agreement is governed by U.S. law, specifically the laws of Michigan. You agree to the jurisdiction of U.S. courts.

Headings

  • Headings are included in this Agreement for convenience only and shall not affect the construction or interpretation of this Agreement.
  • Torturous Conduct

    1. Do not share false, harmful, or private information about anyone without their permission. Also, avoid doing anything that causes emotional harm or breaks any copyright, trademark, or intellectual property laws.
    2. Be respectful to all Cloudbillsystem staff. Support requests should be made politely and professionally. Don't use all caps, exclamation marks, or rude language in emails or support tickets. Any kind of abuse, shouting, or offensive behavior is not allowed.
    3. Making any kind of threat-spoken, written, or through someone else-towards Cloudbillsystem, its staff, or its equipment is strictly against the rules.
    4. Cloudbillsystem alone will decide what counts as a violation of these rules.
    5. If your account is removed because you broke these rules, you will not get a refund.

    Cancellation of Services

    1. You can cancel your services anytime by logging into the Ticket Desk Support System and sending a cancellation request for verification.

    Entire Agreement

    1. These terms and any documents mentioned in them make up the full agreement between you and us. They replace any previous talks, promises, or agreements we had, whether written or spoken.
      • No verbal explanation or information can change what these terms mean. By accepting these terms, you agree that you're only relying on what is written here, and not on anything else that was said or promised.
    2. Cloudbillsystem can update these Terms of Service at any time.
    3. 3. It's your responsibility to check these terms from time to time for any changes.
